Track every step of winding up a deceased estate in South Africa. Check off completed steps, see deadlines, and estimate the costs involved.
Estate Administration Steps
Get death certificate from Home Affairs
Within 3 daysTake the medical certificate to Home Affairs. You'll get the official DHA-1663 death certificate.
Find the will
Within 7 daysCheck at home, with their attorney, bank, or the Master's Office. If no will exists, the estate is 'intestate'.
Report estate to Master of High Court
Within 14 daysSubmit death certificate, will (if any), and estate inventory to the Master's Office in your area.
Executor appointed (Letters of Executorship)
2-6 weeksThe Master issues Letters of Executorship. Without this, no one can access the deceased's accounts or assets.
Open estate bank account
After appointmentThe executor opens a dedicated estate account to collect all assets and pay debts.
Advertise for creditors
Within 30 days of appointmentPlace notices in the Government Gazette and local newspaper for creditors to submit claims.
Collect assets and pay debts
30-90 daysTransfer all assets to estate account. Pay funeral costs, debts, and outstanding bills.
Get SARS tax clearance
Before distributionFile the deceased's final tax return and get a clearance letter from SARS. This can take 2-6 months.
Prepare Liquidation & Distribution account
After tax clearanceList all assets, debts, and how remaining assets will be distributed to heirs.
Lie open for inspection (21 days)
21 daysThe L&D account must be available for public inspection for 21 days. Heirs can object during this time.
Distribute assets to heirs
After 21 daysTransfer property, pay out cash, and distribute assets as per the will or Intestate Succession Act.
File final executor account with Master
Within 6 months of distributionSubmit proof that everything has been distributed correctly. The estate is now closed.
